Memryze Privacy Policy

1. Who We Are

Memryze is operated by AIxcel Labs LLC, a Virginia limited liability company ("AIxcel Labs", "we", "our", "us"). This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you use the Memryze mobile application and related services (the "Service").

2. Information We Collect

We do not sell personal information. We do not use third-party ad SDKs or cross-app tracking in the current product version.

3. How We Use Information

• Provide app functionality, including note creation, organization, search, and reminders.
• Process AI queries you explicitly submit and return relevant summaries from your notes.
• Maintain platform and account security, prevent fraud and abuse, and enforce these policies and our Terms of Service.
• Comply with legal obligations and resolve support requests.

4. AI Processing and Model Providers

When you use the AI Query feature, we send only the note content and question needed to answer you to our AI provider — currently Anthropic (maker of Claude). We also use trusted cloud partners, including Amazon Web Services, to host the app and help find the right notes to answer your question. We may change providers over time to keep offering the same feature.

• Everything is encrypted while in transit.
• These providers only process your data to help deliver the feature to you — they don't get to use it for anything else.
• We configure providers not to use your data to train their own AI models, wherever their contract and controls support it.
• AI responses may contain mistakes; please double-check anything important before acting on it.

5. Health Information — Not a HIPAA-Covered Service

Memryze is a general-purpose note-taking application. AIxcel Labs is not a HIPAA "covered entity" or "business associate," and the Service is not designed, certified, or offered as a HIPAA-compliant system.

• Any health-related detail you choose to type into a note (for example, an appointment reminder) is stored and processed the same way as any other note content described in Section 2 — it does not receive special handling as Protected Health Information (PHI), and we make no HIPAA-equivalent guarantee over it.
• Do not use Memryze to store medical records on behalf of a healthcare provider, health plan, or clearinghouse, or as a substitute for a system that carries such compliance certifications.

6. Data Storage, Retention, and Deletion

• Your notes are stored securely in the cloud so you can access them from your device.
• Deleted notes may still be recoverable for up to 30 days (in case you change your mind), then they're permanently deleted.
• If you ask the same AI question twice in a short window, we may briefly reuse the answer (for up to 1 hour) so it comes back faster — after that, it's gone.
• When you delete your account or sign out, we remove the data your device uses to receive reminder notifications.

7. Legal Bases (EEA/UK Users)

• Contract: to provide core app services requested by you.
• Legitimate interests: service security, abuse prevention, troubleshooting.
• Consent: where required for specific communications or optional processing.
• Legal obligations: compliance with applicable law and lawful requests.

8. Your Privacy Rights

Depending on your location, you may have rights to access, correct, delete, export, or object to certain processing of your data. You may submit requests by emailing privacy@aixcelabs.com. We may verify your identity before fulfilling requests.

We do not sell or share personal information for cross-context behavioral advertising, so there is no "opt-out of sale/share" action needed. Where applicable law (such as the CCPA) grants a right to non-discrimination for exercising your privacy rights, we will not deny you the Service, charge you a different price, or provide a different level of quality solely because you exercised a privacy right.

9. International Transfers

Your information may be processed in countries other than your own. Where required, we use appropriate safeguards for international data transfers.

10. Security

We use administrative, technical, and organizational safeguards appropriate to the sensitivity of the data we process. No method of storage or transmission is fully secure, and we cannot guarantee absolute security. You are responsible for the information you choose to type into a note, and for using a strong, unique password for your account.

11. Data Breach Notification

If we become aware of a security incident that compromises your personal information in a manner that requires notification under applicable law, we will notify affected users and, where required, relevant regulators, without undue delay and in accordance with the timelines required by applicable law.

12. Aggregated and De-Identified Data

We may create aggregated or de-identified data derived from usage of the Service (for example, overall feature-usage statistics) that does not identify you. We may use such data for analytics, security monitoring, and product improvement without further restriction, since it does not constitute your personal information.

13. Children

Memryze is not directed to children under 13 (or the minimum age required by local law). If we learn we have collected data from a child in violation of this policy, we will delete it.

14. Changes to This Policy

We may update this Privacy Policy. Material changes will be reflected by an updated effective date above and, where required by law, communicated in-app or by other reasonable means.
